Restriction Codes and Work or Residence Permit Refusals in Turkiye

· ≈4 min read · Individual Matters

A restriction (tahdit) code on a foreigner's immigration record can cause work permit or residence permit refusal even where other conditions are met.

i. Direct Answer

When a work permit or residence permit refusal is linked to a restriction code, the applicant should identify the exact code and its underlying ground before assuming the restriction is either permanent or correctly applied. Many restriction-related refusals can be addressed once the underlying record is clarified or corrected.

Restriction codes, commonly referred to as tahdit codes, are administrative markers placed on a foreigner's immigration record for reasons such as a prior deportation decision, an entry ban, an overstay record, a public order or security concern, or an unresolved administrative matter. These codes are checked automatically during work permit and residence permit evaluation, and their presence can result in refusal even where the applicant otherwise appears to meet the substantive criteria for the permit sought.

Restriction codes operate within the broader framework of Law No. 6458 on Foreigners and International Protection, which governs entry, stay, removal, entry bans and the administrative decisions that generate these records. The specific technical coding system is an internal administrative practice built on top of these statutory grounds, but the underlying legal basis for any restriction must trace back to a lawful administrative decision.

iv. Verified Court and Administrative Practice

Authorities cross-check restriction records when evaluating work permit and residence permit applications, and a matching code generally results in refusal pending clarification or removal of the underlying restriction. In administrative practice, applicants who successfully resolve the underlying decision, such as by obtaining cancellation of a deportation decision or expiry of an entry ban, are generally able to have the associated restriction addressed so that a new application can proceed.

v. Doctrine and Practical Debate

A central practical issue is that applicants are often unaware a restriction code exists until a work permit or residence permit application is refused, since the code itself is not always independently communicated in advance. This creates a debate about how proactively a foreigner should check their own immigration record before making significant plans, such as accepting a job offer or renewing a residence permit, particularly where past immigration history includes an overstay, a prior refusal or any contact with removal proceedings.

Before addressing a restriction-related refusal, the applicant should identify the specific restriction code cited, obtain the underlying decision that generated it where possible, gather any documents showing the restriction should not apply or has already lapsed, and assemble a complete immigration history including prior permits, entry-exit records and any deportation, detention or entry-ban documents.

vii. Time Limits and Procedural Deadlines

Where the refusal itself is challenged, ordinary administrative objection and litigation deadlines apply and run from notification. Separately, where the underlying restriction stems from a specific decision such as an entry ban with a defined duration, the relevant timeframe for that restriction to lapse must be tracked independently of any objection to the permit refusal itself.

viii. Competent Authority or Court

The provincial migration authority and the Ministry responsible for work permits handle the underlying permit application and refusal. Administrative courts have jurisdiction over challenges to the deportation, entry-ban or other administrative decision that generated the restriction, where such a challenge is available and timely.

ix. Required Documents and Evidence

Useful evidence includes the refusal decision citing the restriction, any prior deportation, detention or entry-ban documents, entry-exit records, evidence addressing the factual basis of the original restriction, and documentation showing the passage of any applicable time period since the restriction was imposed.

x. Common Mistakes and Misconceptions

Applicants sometimes assume a restriction code is permanent when it may in fact be time-limited or tied to a decision that can itself be challenged. Others attempt to resolve the work permit or residence permit refusal without addressing the underlying restriction, resulting in repeated refusals on reapplication. It is also a mistake to rely solely on informal explanations from third parties about why a code was applied, rather than obtaining the official decision.

xi. Assessment by Our Lawyers

Restriction-code refusals require tracing the record back to its origin, since the code itself is only a symptom of an earlier administrative decision. We help clients identify the underlying ground, assess whether it can be challenged or has lapsed, and coordinate the sequence of steps needed before a work permit or residence permit application can realistically succeed.

Frequently Asked Questions

No. Some restrictions are tied to time-limited measures such as entry bans, while others depend on the status of an underlying decision.
